People wishing to sell alcohol by retail need two separate licences under the Licensing Act 2003:

A Premises Licence which covers the premises from which liquor is sold, and, a Personal Licence which anybody wishing to sell or authorise the sale of alcohol must hold.

1. Premises licence

An application for a Premises Licence must be made to the local authority for the area in which the premises are situated. Premises Licences are not subject to renewal and have effect until revoked, suspended or surrendered, or the Licence holder becomes mentally unstable, insolvent or dies. However, an annual fee is payable to the local authority.

2. Personal licence

An application for a Personal Licence must be made to the local authority for the area where the proposed Licence holder lives. It is granted for ten years, and then has to be renewed every ten years. The renewal application has to be to the local authority that granted it even if the Personal Licence holder has moved to a different area.

Different rules apply when alcohol is to be supplied by or on behalf of a club. A Club Premises Certificate application has to be lodged with the local authority in which the premises lie. In these cases there is no requirement for a Personal Licence holder.
