How to have a good divorce (yes, really)

Good is not generally a word that comes before divorce. It is well documented that getting divorced is one of life’s most stressful experiences. With the introduction of ‘no fault’ divorce, thankfully, the legal part of the process can be less painful than before. 
There is a myriad of options to resolve child arrangements and/or financial issues, helping you, and your family, to achieve a ‘good divorce’.

4 key points for a good divorce

  1. Seek specialist, legal advice and get it early! Finding out where you stand helps you to stay in control, reduce stress and set realistic expectations.
  2. Gather your financial information. Knowing what you have as an individual and a family is key to the start of the resolution process.
  3. Be ready. Being willing to negotiate is vital to an early settlement. If necessary, speak to a counsellor to ensure you are psychologically prepared to think about practical and financial issues.
  4. Be open to non-court dispute resolution – Court is stressful and expensive when other, better options are now available.

Dispute resolution can assist in reducing the anxieties, stresses and animosity which come with the Court process. Arbitration, previously more common in commercial situations, is routinely used by divorcing couples, as is family mediation, which can help couples maintain an active dialogue, especially over child arrangements.

For financial agreements, one of the best options is to use a legal professional as an evaluator in a private dispute resolution. Both parties engage with the evaluator to resolve their financial issues, alongside their own solicitors. This is a type of Court assisted mediation, undertaken at the time and place of your choosing.
