Unfair Dismissal Time Limits Explained

Understanding Unfair Dismissal Time Limits

If you have been unfairly dismissed, time is of the essence, and you must adhere to unfair dismissal time limits. Strict legal deadlines apply to bringing a claim, and missing them usually means losing your right to claim compensation. Our Employment Law experts help employees act quickly and decisively. We support clients remotely, ensuring your claim is prepared and submitted on time, no matter where you are based.

  • Understand the strict 'three months minus one day' rule (this is expected to be extended to six months from 1 October 2026 for acts which take place on or after 1 October 2026)
  • Don't wait for internal appeals to finish before acting
  • Know how ACAS Early Conciliation affects your deadline
  • Get expert help to calculate your specific limitation date
  • Receive urgent advice remotely to protect your claim

What are the Unfair Dismissal Time Limits?

The general rule is strict: you have three months minus one day from your 'Effective Date of Termination' (the day your job ended) to start the legal process (this is expected to be extended to six months from 1 October 2026 for acts which take place on or after 1 October 2026). For example, currently if you were dismissed on 5th July 2026, your deadline to contact ACAS would usually be 4th October 2026. Missing this date by even 24 hours can bar you from bringing a claim.

Do Not Wait for Your Appeal

This is a common trap. If your employer is dragging out your internal appeal process, the clock on your tribunal claim does NOT stop.

You must start your legal claim within the three-month window (this is expected to be extended to six months from 1 October 2026 for acts which take place on or after 1 October 2026), even if your appeal is still ongoing. We can help you manage both processes simultaneously to ensure you are fully protected.

Unfair Dismissal Time Limits Explained

We guide you through the critical milestones.

  1. Termination Date: Identify exactly when your employment ended. This starts the clock.
  2. Urgent Advice: Contact us immediately. We verify your deadline and assess your claim.
  3. ACAS Conciliation: You must notify ACAS before the deadline. This 'pauses' the clock temporarily.
  4. Certificate Issued: Once ACAS issues your certificate, the clock restarts, giving you a short window to lodge your claim.
  5. Tribunal Claim: We submit your ET1 form to the tribunal before the final deadline expires.

I honestly can't recommend Winston Solicitors enough. I reached out to them when I was in need of employment law advice and received a call from Samira. She was friendly and gave me some advice when my world had been turned upside down. Samira handled my negotiation for me, along with her excellent colleague. They made me feel comfortable, stood up for me and my rights, and negotiated a great package.

I would wholeheartedly recommend them and would not hesitate to contact Winston Solicitors if I ever need legal help again.

It is very difficult to proceed. Tribunals rarely allow late claims unless it was 'not reasonably practicable' to file on time (e.g., you were in hospital). Ignorance of the time limit is not an excuse.

Yes, but the rules are technical. Contacting ACAS 'pauses' the limitation period, usually extending your deadline by at least a month. We can calculate the exact new date for you.

It starts from your 'Effective Date of Termination'. If you were paid in lieu of notice, this is usually the day you left. If you worked your notice, it is the last day of your notice period.

Yes, for constructive dismissal. The time limit starts from the date you resigned (or your last day of notice if you gave it). The same strict three-month rule applies.

It is three months minus one day (this is expected to be extended to six months from 1 October 2026 for acts which take place on or after 1 October 2026). So if you were dismissed on 1st March, your deadline is 31st May (not 1st June).
