Maternity leave is a protected legal right for eligible employees in the UK. You can take up to 52 weeks of leave, which includes 26 weeks of Ordinary Maternity Leave (OML) and 26 weeks of Additional Maternity Leave (AML). Many parents can also share leave with the other parent through Shared Parental Leave (SPL).

During maternity leave, you are protected from dismissal, detriment, or discrimination and you have the right to return to the same or similar job with the same terms and conditions. You may also be entitled to Statutory Maternity Pay (SMP) for up to 39 weeks.

  • Up to 11 weeks before your expected week of birth.
  • The day after birth if your baby is premature.
  • Following pregnancy-related ill-health absence in the 4 weeks before birth.
