Securing the Unfair Dismissal Compensation You Deserve

Compensation is designed to put right the financial wrong you have suffered. However, calculating it correctly requires legal expertise. With over 4,000 five-star reviews, Winston Solicitors has a proven track record of helping employees secure fair settlements and tribunal awards.

Many employees undervalue their claims by missing out on pension loss or future earnings. We ensure every penny is accounted for. Studies show that unrepresented claimants lose out on thousands by failing to properly calculate complex long-term losses, whereas expert legal representation typically ensures a comprehensive schedule of loss that accurately reflects your true financial damage.

I was offered a small settlement to leave quietly. Winston Solicitors reviewed my case, identified I was being underpaid on notice, and negotiated a package that gave me financial security for six months.

When Can You Claim Compensation?

You may be entitled to unfair dismissal compensation if your dismissal was 'unfair.' This happens when your employer:

  • Did not have a fair reason (like misconduct, capability, or redundancy).
  • Did not follow a fair procedure (like holding a disciplinary hearing or allowing an appeal).

You can also claim if the dismissal was discriminatory (based on age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief and sex) or if it was a breach of contract (wrongful dismissal), such as not paying your notice.

How Is Compensation Calculated?

Unfair dismissal compensation is made up of two main parts:

  1. Basic Award: This is a fixed sum based on your age, length of service, and weekly pay. It is similar to a redundancy payment.
  2. Compensatory Award: This is the main part of the claim. It covers the actual money you have lost because of the dismissal, including lost wages, pension contributions, and expenses while looking for a new job.

The Claims Process for Unfair Dismissal Compensation

We guide you through the steps to securing your unfair dismissal compensation.

  1. Case Review: We assess your dismissal to confirm if it was unfair and estimate the potential value.
  2. Evidence Gathering: You provide us with your payslips and details of your contractual benefits. We use these to calculate your losses.
  3. Negotiation: We can approach your employer to negotiate a settlement (often a Settlement Agreement) to avoid going to an employment tribunal.
  4. Tribunal Claim: If they refuse to pay, we lodge a claim with the Employment Tribunal.
  5. Representation: We fight your corner at the hearing to secure the award you deserve.

From first contacting Winstons Solicitor, I was really impressed with the care, concern and empathy with which I was met. My subsequent meeting with Samira continued in the same way and I was able to benefit from clear, concise and invaluable professional advice clearly gained from years of experience. Thank you.

We fight hard for our clients. Employers often try to lowball compensation offers. We know the true value of your claim and ensure you don’t settle for less.

We are here to help you get the compensation you are entitled to.

It varies. The Basic Award is a fixed formula, but the Compensatory Award depends on how long you are out of work. We can give you a personalised estimate.

Yes. The Compensatory Award is currently capped (set to be removed on 1 January 2027) at one year's gross pay or a specific statutory amount (whichever is lower). However, discrimination claims have no upper limit.

You must try to find new work ('mitigate your loss'). If you get a new job quickly, your compensation for lost wages will stop from the date you start the new role.

Not for a standalone unfair dismissal claim. However, if your dismissal involved discrimination, you can claim a separate award for 'injury to feelings'.

Strictly three months minus one day from the date your employment ended. You must contact ACAS before this deadline to start the process.
