Angela Rayner Resigns Over Conveyancing Error

In the last week, the headlines have been dominated by one particular story. Deputy Prime Minister Angela Rayner resigned after it emerged that she had underpaid around £40,000 in stamp duty on a second property.

The property was a seaside flat in Hove purchased for £800,000, but she paid the lower “primary residence” rate instead of the higher second-home rate. The kerfuffle, and resulting resignation, really shows how even high-profile figures can stumble when tax implications meet property law.

What Actually Happened with Angela Rayner’s Property?

Angela Rayner bought the Hove flat in May, paying roughly £30,000 in stamp duty. The higher rate, for additional homes, would likely have been around £70,000. She was advised that, because she had placed her Manchester house into a trust for her disabled son, she no longer owned it, making the Hove property her only residence. She claimed she “acted in good faith,” but later legal advice and media scrutiny revealed that this interpretation was flawed. As a result, ethics advisers concluded she breached the ministerial code. Rayner resigned from all her roles, saying she “deeply regrets” not seeking specialist tax guidance.

Why This Still Matters for Anyone Buying a Property

It’s tempting to think this is political theatre, but there’s a serious point to be made. The rules around property tax are intricate. Whether it’s defining your main residence, dealing with trusts, or spotting exemption details, small missteps can lead to big financial consequences. Rayner’s case shows the cost in money, reputation, and career, of missing a detail on property tax. Even for everyday buyers, ignorance is no defence. Misclassifying your property can mean thousands of pounds lost.

Conveyancing solicitors aren’t just there to handle paperwork. Their role is to spot these nuances, ask the right questions, and flag anything that could trip you up later.

Common Stamp Duty Pitfalls

There is a not-so-subtle message for all property buyers in this story. Here are a few issues you’ll want your conveyancer to help you with:

  • Trusts and ownership. Moving your name off a deed (even into a family trust) doesn’t always make the property disappear from tax calculations.
  • Residence status inconsistencies. Being registered as living in one place for council tax but claiming another as your main home for stamp duty? That can raise serious red flags.
  • Rate assumptions. Don’t assume the standard rate applies. Double-check if additional rates kick in.
  • Changing circumstances. A small change in your situation can change property tax liability. Keep advisors updated from start to finish.
