The legal ground for divorce
In England and Wales, there is only one legal ground for divorce: that the marriage has irretrievably broken down
Since April 2022, divorce has been based on a no-fault system. This means neither party has to blame the other, which many couples find reduces conflict and stress at an already difficult time.
The divorce process explained
Divorce proceedings can be started by one person or jointly as a couple. An application is made to the court, which begins the formal process.

How long does a divorce take?
There are set timeframes within the divorce process, which cannot usually be shortened.
After the divorce application is issued, there is a minimum 20-week period before you can apply for a Conditional Order (previously called decree nisi). Once the Conditional Order is made, there is a further 6 weeks delay before applying for the Final Order.
In most cases, this means a divorce takes around seven to eight months, sometimes longer if financial matters are still being resolved as often it is appropriate to delay finalising the divorce until those are dealt with.
Sorting finances alongside divorce
Although divorce legally ends a marriage, it does not automatically deal with finances. Many people are advised to resolve financial matters and obtain a financial order before applying for the Final Order.
