CICA Compensation for Injuries Caused by Knife Stabbings

It is important to recognise that whilst a Stabbing or would be defined as a crime of violence under the CICA scheme, simply because one has sustained a stab wound, does not automatically entitle to them to knife crime compensation.

The CICA pay compensation for scarring, internal injuries, tendon or ligament damage and fractures associated with stabbings. It may also be possible to claim for psychological trauma if this has been diagnosed by a psychiatrist or clinical psychologist.

If you have a stab wound that has healed well with no appreciable scarring or other associated injury – it is unlikely you will be able to claim for the act of stabbing alone.

What other factors do the CICA consider when making awards for Stabbing injuries?

As with all other claims, the CICA will consider the conduct, cooperation and convictions of a victim before deciding whether compensation can be made. This means you must be the innocent victim and not have contributed to the assault/incident in any way; the crime must have been reported to the police as soon as reasonably practicable and you must have cooperated with the police investigation. Your own criminal convictions, should you have any, must be spent.

How long do knife crime cases take?

The CICA has no set timescales. Using a CICA expert can help you progress more effectively though the process. There are a number of outside organisations which we must rely upon for providing the evidence to support your case, namely the police and medical agencies.

The main delay we sometimes see in knife crime cases, is the CPS deciding whether to prosecute. If they do, then the police report is not normally released until after the trial. This can delay your compensation by a number of months. However, do not wait until the trial before making a claim, as you could end up being out of time.

The CICA scheme states that an application should be submitted to the Authority as soon as reasonably practical and therefore we advise you not to wait to make your claim.

There are certain criteria that need to be met in order to be eligible for compensation under the CICA scheme 2012; the main ones are listed below:

To bring forward a CICA claim:

• The incident must have occurred in the UK, and you must have been ordinarily resident in the UK at the time
• The incident can relate to any injury caused by a deliberate act of violence.
• The crime must have been reported to the police (Usually within 48 hours)
• Usually, a claim must be made within two years. There are some exceptions to this rule. Please note, for children, the two-year time limit runs up until their 20th birthday.
• An applicant’s ‘conduct’ must not have contributed to the crime(s) *
• All previous criminal convictions of an applicant MUST be spent. Pending convictions may also affect an application.
• The injuries must fall under the CICA compensation scheme
• Claims regarding sexual abuse rely heavily on police evidence
• Claims for ‘mental injury’ are assessed strictly. An applicant can ONLY claim for mental health where they have been clinically diagnosed by a psychologist or psychiatrist in relation to their mental health (a GP, Counselling, mental health advisor, psychological therapist are simply not enough)
• The offender must not be able to benefit from any award made to you. This applies mainly to domestic abuse cases.

What CANNOT be claimed:

• “Minor” physical injuries such as a broken nose, broken ribs, bruising or a black eye are not claimable.
• “Minor” and short-lived psychological injuries – this would refer to depression and anxiety treated solely by a GP with no other formal treatment or diagnosis.
• Damaged or lost/stolen property cannot be claimed for.
• Road Traffic offences are excluded – unless the vehicle has been used as a weapon with the intent to cause injury
• Dog bite/ Animal attack – unless the animal was used as a weapon and ordered to attack purely to cause injury.
